Terms of service
01Who we are
Pagedock ("we", "us") is a small web design studio run by Adam Proksch, doing business as Pagedock, based in Novato, California. We design, build and host websites for clients. These terms apply to anyone who visits pagedock.app, sends us an enquiry, or views a site we host.
If you hire us to build a website, the Website Services Agreement and your written quote also apply. If anything conflicts, the quote wins, then the Agreement, then these terms.
02Enquiries and quotes
Sending the contact form or emailing us does not create a contract or commit you to anything. We may decline any project. A project only starts when you accept a written quote, as described in the Agreement.
03Preview sites
Preview links are for reviewing work in progress. They are not finished products, may change or go offline without notice, and should not be relied on for business use until launch. Please don't share a preview publicly unless you're happy for it to be seen.
04Acceptable use
We won't build, and we don't host, sites that:
- break the law or help someone else break it;
- infringe copyright, trademarks or other rights;
- are deceptive, including phishing, scams, fake reviews or impersonation;
- contain malware, or are used to send spam;
- harass or threaten people, or promote hatred or violence;
- contain sexual content involving minors, or other content illegal to host in the United States.
We may suspend or remove any site that breaks these rules. Where it's safe and lawful to do so, we'll tell the owner first.
05Reporting a site and copyright notices
Use Report a site or email us to flag a hosted site. For a copyright complaint, include: your contact details, the work you say is infringed, the exact address of the material, a statement that you believe in good faith the use isn't authorised, a statement under penalty of perjury that your notice is accurate and you're authorised to act, and your signature. Site owners can send a counter-notice with the same level of detail. We remove material that is the subject of a valid notice, and repeat infringers lose hosting.
06Our content
The pagedock.app website, the Pagedock name and logo, and our own tools belong to us. Rights in client sites are set out in the Agreement.
07No warranty
Except where the Agreement or the law says otherwise, pagedock.app and hosted sites are provided "as is" and "as available". We don't promise they will always be online or error-free.
08Limits on liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to the website or our services is limited to the amount you paid us in the twelve months before the claim, or $100 if you haven't paid us anything. Nothing here limits liability that can't be limited by law.
09Law and disputes
These terms are governed by California law, without regard to its conflict-of-laws rules. Before starting any formal dispute, please email us so we can try to sort it out; we'll do the same. Any lawsuit must be brought in the state or federal courts for Marin County, California, and both sides agree to those courts' jurisdiction. Either side may use small-claims court instead where it qualifies. If you are a consumer in a country whose law gives you the right to bring a claim at home, that right isn't affected.
10Changes to these terms
We may update these terms. The date at the top shows the current version. A change doesn't affect a project you have already accepted a quote for, unless you agree to it.
